Terms of Use

Article 1 — Purpose

These terms of use (hereinafter "TOU") define the conditions of access to and use of the website pellissier-sports.fr (hereinafter "the Site"), published by Pellissier Sports, a trader established at 74340 Samoëns, Haute-Savoie, France, affiliated with the Ekosport Rent network. Any access to the Site implies unreserved acceptance of these TOU.

Article 2 — Access and availability

The Site is freely accessible 24 hours a day, 7 days a week, subject to interruptions required for maintenance, updates or technical or force majeure reasons. Pellissier Sports does not guarantee continuous, uninterrupted availability of the Site.

Access to the Site requires an internet connection, the cost of which is borne by the user. Site compatibility is ensured for modern browsers (Chrome, Firefox, Safari, Edge, recent versions).

Article 3 — Accounts and administration

The Site does not offer public customer account creation. Bookings are made without prior registration and order details are communicated by email. Only Pellissier Sports administrators have authenticated access to the administration area, reserved for managing the catalogue, bookings and Site content.

Any unauthorised access to the administration area is strictly prohibited and may result in criminal prosecution in accordance with French law.

Article 4 — Intellectual property

All content on the Site (text, photographs, logos, icons, layout, source code) is the exclusive property of Pellissier Sports or its partners and is protected by French and international intellectual property laws.

Any reproduction, representation, modification, publication, transmission or distortion, in whole or in part, of the Site or its content, by any means, without prior written authorisation from Pellissier Sports, is strictly prohibited and constitutes an infringement of intellectual property rights.

Article 5 — User conduct

The user agrees to use the Site fairly, in accordance with its intended purpose and applicable law. In particular, the following are prohibited:

  • using the Site for fraudulent, illegal or immoral purposes;
  • disrupting the functioning of the Site by introducing viruses, Trojans or any other malicious code;
  • attempting to gain unauthorised access to secure areas of the Site;
  • providing false or misleading information when making a booking;
  • making speculative or abusive bookings with the aim of blocking equipment availability.

Pellissier Sports reserves the right to refuse or cancel any booking from a user who has breached these TOU.

Article 6 — Liability and external links

Pellissier Sports endeavours to keep the information published on the Site (catalogue, prices, availability) up to date but cannot guarantee its accuracy at all times. Information displayed is indicative and may be changed without notice.

The Site may contain hyperlinks to third-party sites (in particular the Stripe payment platform and the Ekosport Rent network). These links are provided for information purposes only. Pellissier Sports has no control over these sites and assumes no responsibility for their content, availability or privacy policies.

Pellissier Sports shall not be liable for direct or indirect damages resulting from the use of or inability to use the Site, except in the case of gross or intentional misconduct on its part.

Article 7 — Personal data and cookies

Pellissier Sports collects and processes personal data in connection with online bookings (surname, first name, email address). This data is processed in accordance with Regulation (EU) 2016/679 (GDPR) and French data protection law.

The Site uses technical cookies essential to its operation (session management, shopping cart, language preference). No advertising cookies or third-party trackers for commercial purposes are placed without prior consent.

Article 8 — Amendments to the TOU

Pellissier Sports reserves the right to amend these TOU at any time. Amendments take effect as soon as they are published on the Site. Users are encouraged to consult the TOU regularly. Continued use of the Site after an amendment constitutes acceptance of the updated TOU.

Article 9 — Governing law

These TOU are governed by French law. In the event of a dispute relating to use of the Site (as distinct from a dispute relating to a booking, which is governed by the GTC), the parties agree to seek an amicable solution. Failing that, the competent court will be that of the registered office of Pellissier Sports.
