General rental terms and conditions

Article 1 — Purpose and scope
These general rental terms and conditions (hereinafter "GTC") govern the contractual relationship between Pellissier Sports, a trader established at 74340 Samoëns, Haute-Savoie, France, affiliated with the Ekosport Rent network (hereinafter "the Provider"), and any adult natural person or legal entity (hereinafter "the Client") making an outdoor equipment booking via the website pellissier-sports.fr.
Any booking placed on the site implies full and unreserved acceptance of these GTC. The GTC in force at the time of booking are those applicable to the contract.
Article 2 — Service description and booking
2.1 Nature of the service
The Provider offers the rental of summer mountain equipment (hiking boots, crampons, harnesses, ice axes, helmets, poles, etc.) to private individuals for personal, non-professional use. The rental is concluded for a fixed period, with pick-up and return exclusively in store in Samoëns.
2.2 Availability and booking
Equipment availability is checked in real time, item by item. A booking is definitively confirmed only after full payment has been received and a confirmation email sent to the Client. Pellissier Sports reserves the right to cancel a booking in the event of unforeseen unavailability, with a full refund in that case.
2.3 Minimum booking lead time
Online booking is available up to 48 hours before the desired pick-up date (minimum D+2). No booking can be made for the same day or the following day.
2.4 Duration and day count
The rental period is calculated in inclusive days (pick-up day included + return day included). Example: pick-up on Monday, return on Wednesday = 3 days.
Article 3 — Prices and fees
3.1 Rates
Prices are expressed in euros inclusive of VAT and vary by equipment category and rental duration (pricing grids: 1 day, 2 days, 3 days, 4 days, 5 days, 6 days, 7 days and above, and weekly flat-rate where applicable). The rates in force are those displayed on the site at the time of booking.
3.2 Booking fee
A booking fee of €1.00 is charged once per booking, regardless of the number of items. This fee covers administrative and booking processing costs; it is non-refundable in the event of cancellation.
3.3 Optional cancellation guarantee
When booking, the Client may take out a cancellation guarantee at a price of €3.00 per booking line. This guarantee allows a refund of the rental amount (excluding booking fee) for any cancellation, including last-minute ones, subject to justification (extreme weather, accident, illness). The terms of the guarantee are detailed in Article 7.
Article 4 — Online payment
Payment is made in full online at the time of booking, by credit or debit card (Visa, Mastercard) via the secure platform Stripe. Card data is encrypted and does not pass through Pellissier Sports servers. No security deposit is required beyond the rental price. Payment is secure and PCI-DSS compliant; 3-D Secure may be triggered by your bank.
The booking is only confirmed upon receipt of Stripe's payment notification. If payment fails, no booking is created.
Article 5 — Collection, pick-up and return in store
5.1 Pick-up
Equipment is collected exclusively in store: Pellissier Sports, 74340 Samoëns. The Client must attend on the first day of the rental period during shop opening hours, with their confirmation email and a valid ID. The Provider prepares equipment in advance to minimise waiting time.
5.2 Return
Equipment must be returned on the last day of the rental period before shop closing time. Any late return is charged at the current daily rate, rounded up to the next full day.
5.3 Return inspection
Upon return, a Pellissier Sports technician will inspect the equipment in the Client's presence. A return report may be drawn up if damage is found.
Article 6 — Obligations of the Provider and the Client
6.1 Provider's obligations
Pellissier Sports undertakes to provide equipment that is checked, clean and in good working order. If it is unable to provide the booked equipment, the Provider will offer equivalent equipment or arrange a full refund.
6.2 Client's obligations
- Use equipment in accordance with its intended purpose and in compliance with applicable safety rules.
- Not sub-let, lend or transfer equipment to a third party without prior written consent from the Provider.
- Return equipment in the same condition as received (fair wear and tear accepted).
- Immediately report to the Provider any incident, malfunction or defect noticed during the rental.
In the event of loss, theft or abnormal damage, the Client is held liable and must pay the replacement or repair cost as estimated by the Provider, based on a formal quote.
Article 7 — Cancellation and refunds
7.1 Cancellation by the Client without guarantee
- More than 48 hours before pick-up: full refund of the rental price, excluding the non-refundable booking fee.
- Less than 48 hours before pick-up: no refund, except in cases of force majeure duly evidenced and assessed at the Provider's sole discretion.
7.2 Cancellation by the Client with cancellation guarantee
If the Client has taken out the cancellation guarantee, they may cancel at any time before pick-up and receive a refund of the rental price (excluding booking fee and guarantee cost), upon submission of evidence accepted by the Provider (weather report, medical certificate, accident declaration, etc.).
7.3 Cancellation by the Provider
If the Provider cancels (force majeure, unforeseen equipment unavailability), the Client is fully refunded within 14 business days.
7.4 Refund method
Refunds are made via the same payment method used at the time of booking (credit card reversal), within 5 to 10 business days depending on the Client's bank.
Article 8 — Right of withdrawal
Pursuant to Article L221-28 11° of the French Consumer Code, the 14-day right of withdrawal does not apply to contracts for the rental of goods concluded for a specific date or period. By booking online for specific dates, the Client expressly acknowledges being informed of this exception and consents to it.
Article 9 — Liability
Pellissier Sports cannot be held liable for personal injury, property damage or consequential loss resulting from misuse of the rented equipment, a sporting activity unsuited to the Client's level, or third-party interference. The Client engages in mountain activities at their own risk.
The Provider's liability cannot be engaged in the event of force majeure (exceptional weather, natural disaster, strike, epidemic, etc.).
Article 10 — Personal data
Personal data collected during booking (surname, first name, email address) is used exclusively for processing and tracking the booking, and for sending transactional emails related to it. Article 11 — Governing law and disputes
These GTC are governed by French law. In the event of a dispute, the parties agree to seek an amicable solution before any legal proceedings. Failing agreement, the Client may refer to consumer mediation: the Provider undertakes to propose a consumer mediator in accordance with Articles L612-1 et seq. of the French Consumer Code. Failing that, the competent court will be that of the Provider's registered office.
